
Our May rent is due tomorrow. We were supposed to get a new lease for this May with a rent increase. Our apartment is rent stabilized which means that the rent can not be raised over a certain percentage. This percentage is decided by some city board (too lazy to research this) each year. It is always a big argument between landlords and the serfs. I think this year our rent is only supposed to go up 3 percent or something like that - maybe even a little less than that.
The last time I saw Stingy Landlord, he mentioned that he would be sending a new lease soon. Never got one. And now our rent check is due - with no mention of a rent increase. Stingy Landlord charges us to the penny. There is no way that he has decided not to raise our rent. My guess is that he has simply overlooked this fact temporarily.
I'll gladly take the discount but I'm wondering if he can charge back rent when he discovers his error. The fear of that, however, will not lead me to let him know about his oversight.

dude, his mistake , his cost. don't pay a dime over what you normally do untill he sends you a new lease. you may also want to see what he can do about your obnoxious neighbors- is he their landlord too?

All you need to know:
When a tenant receives the Lease Renewal Form, a copy of the Rent Stabilization Rights Rider For Apartment House Tenants Residing in New York City must be attached. The Rider will explain how the proposed rent was computed and describe the rights and obligations of tenants and owners under the Rent Stabilization Law. A renewal lease should go into effect on or after the date that it is signed and returned to the tenant. In general, the lease and any rent increase should not begin retroactively.
The Rent Guidelines Board (RGB) by Order No. 37 has set the following maximum rent increases for leases
subject to renewal on or after October 1, 2005 and on or before September 30, 2006 for apartments under
its jurisdiction:
1 Year-2.75% 2 Years-5.5%
Sorry your landlord is a schmuck, definitely don't go being assertive to suit them though. In fact, tell them you paid the rent already, keep them on their toes, urp.
